A partire dall’inizio degli anni ‘80 si è assistito ad una rapida diffusione dei processi di esternalizzazione dei servizi pubblici. L’obiettivo del presente lavoro è investigare come gli enti locali esercitano la loro funzione di “acquirenti” di servizi pubblici tramite meccanismi di contrattazione formale e relazionale. Lo studio è stato condotto tramite un’analisi di casi multipli. I risultati che emergono supportano l’idea che l’approccio formale e l’approccio relazionale alla contrattazione sono complementari, seppure esista un certo livello di varianza tra i casi, che sembra essere giustificata da fattori legati alle caratteristiche dei servizi esternalizzati (misurabilità e programmabilità), all’interesse del fornitore a costruirsi una buona reputazione, alla natura del fornitore, alla durata della relazione, alla distribuzione delle informazioni e delle responsabilità tra i contraenti.
Since the early Eighties the contracting out for the delivery of public services has been increasing in different countries. The aim of this paper is to analyze how Local Authorities carry out their pur-chaser function through formal and relational contracting. The research is carried out by a cross case analysis. Results show that formal and relational contracting are complementary, although a certain degree of variance seems to emerge between the cases analyzed. The governance system appear to be affected by public service characteristics (measurability and programmability), the provider’s search for reputation, the nature of the provider, the length of the contractual relationship, the distribution of information and responsibility between governments and their contractors.
